「新月梧桐」夫妻反目 法官裁定離婚無效

台中知名餐飲集團「新月梧桐」，創辦人翁博文與羅友竹，9年前離婚，日前為了贍養費，鬧上法院，今天案情有戲劇性發展！台中地院審理後，認定離婚見證人有瑕疵，因此，離婚協議書無效，由於兩個各自嫁娶，複雜的婚姻關係是否存在？法官6月24日，將會開庭釐清。

「新月梧桐」餐廳夫妻檔，2005年離婚，女方提告，訴請前夫支付1400萬贍養費，結果法官認為，當時離婚代書找的證人，不是親自簽名、蓋章，又不識字，證人少了一位，離婚無效。

獲悉和前夫的離婚無效，羅友竹難以接受，拿出9年前的離婚協議書，強調當初白紙黑字，說好一個月30萬的贍養費，前夫不給就算了，還提出離婚無效訴訟，居心叵測。

女方指控前夫，開餐廳打對台，還挖角、削價，男方全盤否認，甚至為了貪財傳聞，鄭重澄清。

離婚後，雙方已各自嫁娶，如果是「故意」，就有「重婚」之嫌但如果當事人是善意、無過失，就變成「後婚」成立，前婚自動消滅。

情與錢，糾葛出複雜的四角關係，外界很難懂，只能交給法官判。(民視新聞張士政、賴政坤台中報導)
