總統府認為，台北市廉政會建議將前市長馬英九移送法辦，是刻意「政治迫害」入人於罪的舉動。台北市長柯文哲今（9）日受訪表示，現任總統說自己遭到政治迫害，令他「啼笑皆非」、「滿有趣的」。

柯文哲說，北市昨晚舉行無預警水災演習，我家已經快11點了，翻了幾頁，發覺太複雜了，所以就睡著了，今又來台中市，廉政會有其建議，他自己要先讀一讀，等周一找法務局、財政局檢討，再決定下一步怎處理。

柯文哲表示，因為廉政會只是建議，「不見得北市府一定要照做」。

他還特別聲明，廉政會是獨立作業單位，「我都沒去管他們，這案子從頭到尾都是副市長鄧家基主持，我根本連去都沒怎麼去，專案小組我也沒有去參與，所以要如何執行，我還要想一下」。
